Right of Withdrawal

This cancellation policy applies exclusively to consumers pursuant to § 13 BGB (German Civil Code) for contracts concluded at a distance (e.g., online).

For entrepreneurs pursuant to § 14 BGB, there is no statutory right of withdrawal. If TermShelf voluntarily grants entrepreneurs a discretionary right of cancellation or return, this will be agreed separately and expressly.

With TermShelf, you first register free of charge. For the first 30 days (the trial period), there is no payment obligation. You may delete your account at any time during the trial period; in that case the trial access ends and no charges apply.

A paid subscription is only concluded once you select a paid plan after the trial period ends (or actively book it beforehand, where offered). From the conclusion of the paid subscription, the right of withdrawal described below applies.

If you conclude a paid subscription, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of conclusion of the contract.

by means of a clear statement (e.g., by email or letter) of your decision to withdraw from this contract. To help us assign your request more quickly, please include details such as the email address / customer number you use with TermShelf (if available).

You may use the model withdrawal form provided below for this purpose, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification concerning the exercise of the right of withdrawal before the withdrawal period expires.

If you withdraw from this contract, we will refund all payments we have received from you without delay and no later than within 14 days from the day on which we receive notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise.

Upon the withdrawal taking effect, your access to the paid plan ends; all data stored with us will be deleted and public delivery (Public Delivery) of your legal texts will no longer be possible. As a result, you lose access to the services of TermShelf.

If you expressly request that we begin providing the service before the end of the withdrawal period, and you withdraw from the contract within the withdrawal period, you must pay us a reasonable amount. This amount corresponds to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of withdrawal in respect of this contract, compared with the total scope of the services provided for in the contract.

In practice, for a subscription this generally means a pro-rata charge up to the withdrawal (e.g., proportional to the days already used).

In the case of contracts for the provision of services, the right of withdrawal may expire before the end of the withdrawal period if we have provided the service in full and you expressly consented, before the start of performance, to our beginning performance before the end of the withdrawal period, and you confirmed that you would lose your right of withdrawal upon complete performance of the contract.

Insofar as digital content is exceptionally provided that is not supplied on a tangible medium, the right of withdrawal may expire if we have begun performance of the contract after you expressly consented and confirmed your awareness of the loss of the right of withdrawal.

TermShelf is provided as a continuous digital service on a subscription basis. Within the 14-day withdrawal period, the service is generally not provided “in full”. An early expiry of the right of withdrawal within this period is therefore normally not applicable – however, compensation may be payable if you requested immediate commencement (see above).

During the free trial period, no payment is due; a withdrawal there is typically not necessary, since you can delete your account at any time.
